Terms of Use

1. Acceptance of Terms

By accessing or using AIEShop ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including store owners, administrators, and any person who accesses or uses the Service.

2. Description of Service

AIEShop is an AI-powered analytics and conversion optimization application for Shopify stores. The Service provides real-time visitor tracking, customer behavior analysis, exit intent detection, conversion funnel visualization, and machine learning-based insights to help store owners understand and optimize their online store performance.

3. Account and Registration

Access to the Service requires a valid Shopify store and authentication through Shopify's OAuth system. By installing the application, you:

• Authorize us to access your Shopify store data as required by the application
• Agree to maintain the security of your Shopify account credentials
• Accept responsibility for all activity that occurs under your account
• Agree to provide accurate and current information about your store

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to collect or store personal data in violation of privacy laws
• Resell, sublicense, or redistribute access to the Service without authorization

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, algorithms, machine learning models, text, graphics, logos, and user interface design — are owned by AIEShop and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our prior written consent.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect data. By using the Service, you consent to the data practices described in our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection and privacy laws, including GDPR.

7. Subscription and Billing

The Service may be offered under various subscription plans, including a free trial period. By subscribing to a paid plan:

• You agree to pay all fees associated with your chosen plan
• Billing is processed through the Shopify billing system
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds are handled according to Shopify's refund policies

8. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Service Availability (SLA)

We target 99.5% monthly uptime for the dashboard and tracker ingestion endpoints but we do not guarantee a specific service level unless agreed separately in writing. Scheduled maintenance, Shopify platform outages, and force-majeure events are excluded from uptime calculations.

10. Limitation of Liability

To the fullest extent permitted by law, AIEShop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim arising from your use of the Service shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

11. Refunds

All billing and refunds for the Service are processed through Shopify's standard billing APIs and are subject to Shopify's Terms of Service and refund policies. Subscription fees are non-refundable except where required by law. If the App is uninstalled mid-billing cycle, prorated refunds may be available at Shopify's discretion.

12. Shopify Partner Program & Platform Compliance

The Service is distributed through the Shopify App Store and is subject to the Shopify Partner Program Agreement and the Shopify API License and Terms of Use. In the event of a conflict between these Terms and the Shopify agreements, the Shopify agreements prevail with respect to the Shopify-related obligations.

13. Termination

Either party may terminate the use of the Service at any time. You may uninstall the application from your Shopify store at any time. We reserve the right to suspend or terminate your access if you violate these terms. Upon uninstallation, we retain your data for up to 48 hours to support accidental reinstalls; after that, all shop-level data is permanently deleted in response to Shopify's shop/redact compliance webhook, in line with GDPR requirements.

14. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after any modifications constitutes acceptance of the revised terms. We will make reasonable efforts to notify users of significant changes.

15. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of Greece, without regard to conflict of law principles. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the competent courts.
